don't know anything about the details, but if I had to rule on this, it would come down to weather the second amendment, or any of the other amendments in the Constitution apply to foreign Nationals on American soil. I'm pretty sure the answer is yes, ergo foreign Nationals do have the right to keep and bear arms.
all that said, if illegally crossing the border is a felony, then they would be felons. unfortunately, they have to be convicted felons in order for their rights to be stripped, and nobody is trying or convicting anyone.
this is true for states with background checks. the form explicitly has a question that asks if you are an illegal immigrant. If you lie, it's a felony, and if you mark yes, you get rejected.
The problem is that the 4473 background check form to legally get a gun requires you declare your citizenship and if you're in the US legally. So either we let illegals have guns, or we get rid of the 4473.

I think it would still be illegal to sell them one, unless they're trying to set up universal background checks
