What you're describing sounds like they should definitely not be collecting any fees if the item was returned; it's double-dipping to force you to resell the item and pay another selling fee (along with the other costs you incur).

Like you said, it's kinda weird we haven't seen this taken to court.

Where's a good place to avoid Fee-Bay?

I have stuff I'd like to sell, but have avoided for a while because of the horror stories I have heard about PayPal/Ebay scam!

None of these will work in my instance.

Small items, very varied.

Arrowheads, marbles, older cameras & electronics, deer/goat skulls, fossils, lots of varied stuff. Live far enough away from San Antonio to not be worth my while for anything less than $100 profit. For smaller cheaper items, I want them to drive almost to my house.

I stopped using eBay to sell because they take ridiculously high fees if the item sells and they keep the item if it's said to be defective. I got a video game stolen that way. I paid for the shipping so that the buyer could have it for free. I also sold a TV, bought the insurance, and it got broken after delivery so they did not pay for any of it and I lost the shipping and insurance and the TV. I sold an e-reader after a few years because no one wanted to buy it locally and the buyer said it was defective when it wasn't and wouldn't provide any details. Ebay told me they would refund the buyer and the buyer could keep the item, so I paid for the shipping for the return and lost shipping costs both ways. The buyer also sent it without my original packing material and I got it in a beat up mailer.

eBay is shit. Their new fees are ridiculous and it's not worth selling there between increased shipping prices and fees if and only if everything goes well.
