This is clearly a violation of due process and unfair punishment.

If you surrender to arrest you deserve a trial and jury.

I do not have enough faith in law enforcement to do the right thing to want them to have this sort of power. They are mostly just jack boot thug foot soldiers for the terribly corrupt government bureaucracy and political class.
