The left has used the courts for so many of their advances in the culture war (gay marriage, legalizing sodomy, contraception, CO2 as a pollutant, etc.) that they are putting judicial supremacy if they go at this to hard. They don't want to have the right start to ignore the courts like they did for Brown v Board of Ed.
Judicial supremacy is how in America, if everyone listens to the Supreme Court, since Amendments to overrule them are rare, the final say is the Supreme Court, even if the Court is weak in many ways (they have to rely on others to implement their decisions).
The whole system, left and right, relies upon people believing in the institutional legitimacy of courts, the Supreme Court in particular.
