Thomas, and others, in various cases, like the one overturning the Gun Free School Zones Act (it was reauthorized later) they signaled it was time for a Second Amendment case. It took awhile, but we eventually got DC v Heller when the Right got smart and started to use the courts like the Left has since the 1960s.
