Not sure this is yet suing the government first, I honestly am more of the mind that the people to be sued first would be the talking heads. I also feel that given how trials work it is more about the publicity and bringing things to the foreground having more value than the final outcome.
Can't. Big pharma has immunity baked into their government contracts.
