In fact, you don't even know the difference between fact and theory, and have assumed, that everything remains a theory without further classifications taking precedence:

Now it is true, that a fact still remains a theory once it is proven. But guess what? This theory has never been proven a fact. Which leads us back to the statement you took issue with, which was 100% accurate. Germ theory has never been proven a fact. Which is why it is called a theory, and not a fact, or scientific law.
