The problem I have with your statement is Row vs. Wade had 50 yrs of constructive criticism. Obama said he was going to do something about it, and then didn't.
The Supreme Court is part of our Checks and Balances system. Laws get compared, and its either pass/fail. The election issue had no precedent, and all court cases where scheduled after the inaugeration.
