Judges don't question each other. Whatever Sotomayor says is her professional opinion, wrong or not. She is on a Panel of Nine, with two others that have vocalized their position on what they have perceived of the situation; which would be based on how much research they themselves did on the subject.
Regardless of their position in vaccine-mandates, the majority of Judges on the Bench understand that this is not so much about 'the vaccine', is this is more about OSHA creating a safety protocol, that for the first time in the history of the agency, would be regulating that a standard that is to be "practiced at work" would now force employees to continue protocols outside of the work environment. With more infectious diseases prevalent throughout society why is this the first time that the agency felt the need to mandate a vaccine for work place safety, and why on businesses that have 100+ employees, and not all employees of all businesses since one of the arguments is about protecting all people.
