Just a bit off background on this. Way back in the GW Bush era they passed a law to help reservist military members with student loans if they were deployed. The law has the language of "national emergency" in it as well.

Since covid created a "national emergency" they are using that to extend it to everyone, not reservists getting screwed over.

So, at the time (pre fake covid emergency) they legally didn't have the power, now they say they can do it.
