I think former have no any sense without the latter. BigPharma will just increase fearmongering ads and bribes for doctors for pushing kid's vaccines onto parents brains. It will not be mandated, but fooled parents will ask for them willingly.
Only severe punishment, from huge payments for damage up to confiscations and jailtime for top mangers who participated in bringing imperfect medicine to market for any medicine damaging side effect will change something.
Interesting, that as I heard, in US you could get a huge compensation for too hot coffee served, or product that does not do something advertised, but at the same time you can't sue pharma manufacturer for medicine that does not work or even do harm.
Also, it should be noted, that software manufacturers also allowed to include same irresponsibility in their EULA. Even those who sell very critical software like OSes, different machinery control software and CADs that do strength calculations for architecture, bridges, railways and so on.
