In many jurisdictions lawsuits only succeed if the person can establish they have incurred actual financial harm from discriminatory policies not merely experienced those policies. This kid’s accent is Canadian not American and Canada is such a place.
A guy on nonewnormal tried suing his school for discrimination on his vaccine status and lost on those grounds (he hadn’t incurred financial harm) after spending thousands on attorneys fees.
Publicly calling out the school board including giving their names and accruing them bad publicity is actually better than filing a lawsuit that might not even get accepted past the filing stage. This causes them to have bad publicity and perhaps get abusive messages from patriots who are pissed off at what an eloquent White boy is suffering at the hands of his abusive school. All of this costs the kid nothing.
You're not wrong but then again it costs the board little to nothing too. Proving damages is hard when the courts are politicized. Look at latest trump case for instance.
You can’t sue in most English speaking countries if you can’t prove damages. The kids accent is Canadian. If he sued his school without being able to prove financial harm his case would be dismissed and his parents would have to pay the school’s legal fees in accordance with the Canadian system of costs. This happened to a guy on nonewnormal and happened to a Canadian kid who was suspended for so called transphobic bullying.
Most English speaking countries including Canada have a system of costs where if you sue and the lawsuit is dismissed you must pay the other sides legal fees. This would probably be unconstitutional in America but in most countries it’s in place to prevent people using the courts to settle disputes that arent litigation worthy and can be dealt with outside of court or are simply frivolous.
In Canada the actual destination for a complaint against a school would be the Human Rights Tribunal not your local district court. They will only accept complaints against a school for discrimination if you have experienced disciplinary proceedings at school which have caused your parents to incur financial harm, which were imposed against you based on a protected characteristic, or in matters of expulsion or prolonged suspension. Canadian courts and tribunals have the right to reject a complaint on the filing stage without considering the merits of the case if it is deemed frivolous lol.
So yeah this kid can sue but with his accent being Canadian he’s in a country where he stands no chance of success. Canada isn’t America where you can sue your school for giving you a detention 20 years after it happened.
Best option is to publicly expose the board and its members so they get hate mail from right wing groups. There’s no point filing a lawsuit that you legally can’t win in a country where you’ll have to pay the other sides costs as a result. It happened to that guy at that catholic school in Canada and it happened to a guy who tried to sue for vaccine discrimination that was on nonewnormal. Their parents are now paying the legal fees of their schools because the hunan rights tribunal considered their lawsuits frivolous and without merit.
