Warning: HOAs are shitting all over homeowner Rights, doing all kinds of illegal things and stealing homes. All this is happening because they act like they have the legal power to fine the residents and steal their houses if money isn’t paid. Basically only the Judicial branch can delegate power to issue fines to Government agencies like the Police. They never issued any fine power to HOA which are private Corporations, not Gov agencies. The legislating Branch did so illegally as this power is not theirs to issue and they cannot issue it to the Private entity. The whole thing is unconstitutional as mentioned in the Constitution. Many HOAs have been confronted with this fact and they don’t care. They continue to violate Rights. This is a massive fraud on all homeowners in America and even those who rent. Many of them lost them homes through HOA fraud. They are a predatory parasite and need to be dealt with immediately.

To force HOAs to stop issuing fines illegally, any lawyer who wants to make millions of dollars in a class action lawsuit can file suit against them for not obeying the Federal Judge who confirmed that HOA fines are illegal. HOAs have been ignoring the ruling which means they don't respect the authority of the Government. Any Court will see that this is all correct and the lawsuit would be a slam dunk.
Then, that lawyer and others who get motivated can hit each HOA in a lawsuit one at a time. Eventually the word would spread and other HOAs would be pressured to remove the fine option before they get sued.
The fine system is how the HOAs are able to tyrannize residents in their own private property. The Constitution made separation of powers so stuff like this doesn't happen. If the HOAs are openly violating Constitutional Rights, then any lawyer can make millions of dollars doing class action lawsuits and all Residents who were victimized would get a piece of the lawsuit funds made. Everyone would profit except for the HOAs and the fine system would drop which would essentially revert HOAs to what they once were; basic condo management systems.
The next logical step is for all People who read this to take this information to their local lawyer and ask them if they want to get rich in a class action lawsuit.
People living in HOAs sign a contract to abide by certain shared behaviors. The HOA has the power to foreclose on home owners who do not accorded by these rules and this is where their ability to issue fines comes from. Can credit card companies and banks fine you or are they also unconstitutional? 🤦♂️
As I said, they do not have the power to foreclose or fine per Constitutional Law. I have read all the details. If we run class action lawsuits on any HOA that issues fines, we would win because there is enough evidence to show that issuing fines is illegal and a violation of Human Rights.
Nowhere in the deed did Homeowners agree to be able to receive fines from the HOA.
Also Banks are legalized crime entities and I’m not sure what fine you are talking about specifically. HOAs are much worst because they became predatory parasites as soon as they assumed to have the ability to fine residents. This is why the Constitution exists. To prevent such tyranny.
They can be bad sure but to call them unconstitutional undermines the entire capitalist system and the ability to self organize along with it
