Its not real clear either way. Anyone that tells you he can or can not is bullshitting you.

There is some precedence (PA Senate election that got thrown out in the 90s) and dueling in 1876. You also have the Trump EO that gives the classified DNI report to VP for election fraud.

It could honestly go either way.
